How Foreigners Can Buy a Condo in Thailand
Buyer guidance · Reviewed 15 October 2026
Foreign buyers can own a condominium unit freehold in their own name when they meet the Condominium Act requirements and the building has available foreign ownership quota. The general quota ceiling is 49% of the total area of all units in the condominium.
Start with the title and quota
Confirm that the property is registered as a condominium and ask the condominium juristic person for evidence of available foreign quota. A building marketed as an apartment or serviced residence may not offer the same individual freehold title. Ask an independent Thai lawyer to check the title, ownership history, encumbrances and contract before paying a non-refundable deposit.
Prepare the purchase funds
Discuss the remittance route and required bank evidence with your receiving Thai bank and lawyer before transferring funds. The documents depend on your eligibility route and circumstances. Keep the transfer records, exchange documents and the exact purchaser name consistent with the proposed ownership registration.
Budget for the whole purchase
Request an itemised completion statement covering the agreed purchase price, transfer-related charges, legal work, common fees, any sinking-fund contribution and furnishing. Contract terms determine who pays particular charges. Do not assume that a temporary fee reduction applies to your nationality, property or transaction.
Condo ownership and land ownership differ
A foreign freehold condo title does not give general permission to own Thai land. Villas and land-based arrangements require separate legal advice. Do not treat a nominee company structure or an unregistered renewal promise as equivalent to direct condominium freehold.
A practical buying sequence
Define your budget and intended use; compare suitable properties; verify title and quota; obtain independent legal review; agree the contract and cost allocation; arrange documented funds; inspect the property; and complete registration at the Land Office. Confirm the sequence and required documents with your advisers for the specific transaction.
Common buyer questions
Is foreign quota based on unit count?
No. The general 49% limit is based on the total area of all condominium units, not a simple count of apartments. Confirm the current quota with the juristic person and Land Office.
Does buying a condo automatically give me a visa?
Do not assume that property ownership grants residence rights. Check the current immigration rules separately for your intended stay.
